How to file a copyright infringement notice or counter-notification, and how to reach our Designated Copyright Agent.

Waypoints Digital LLC (“Waypoints”) respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”), we will respond expeditiously to notices of alleged copyright infringement committed using the Compass platform that are reported to our Designated Copyright Agent.
1. How to File an Infringement Notification
If you are a copyright owner or an authorized agent thereof, please submit a formal notification containing the following details to our Designated Agent:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material within the Compass platform.
- Your contact information, including an address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
2. DMCA Counter-Notification Procedures
If you believe that your Customer Content was removed or disabled by mistake or misidentification, you may contest the removal by submitting a written counter-notification to our Designated Copyright Agent listed below. To be effective, your counter-notification must contain the following elements:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside of the United States, for King County, Washington), and that you will accept service of process from the person who provided the original notification of alleged infringement or an agent of such person.
Upon receipt of a valid counter-notification, Waypoints Digital LLC will promptly send a copy to the original complaining party. If the copyright owner does not file a lawsuit seeking a court order against the user within 10 to 14 business days, we are legally permitted, and reserve the right, to replace or restore access to the disputed material at our sole discretion.
3. Repeat Infringer Policy
In accordance with the DMCA and other applicable laws, Waypoints Digital LLC has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of subscribers or users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Compass platform and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
